A Los Angeles Superior Court judge has dismissed the identity-theft conviction of life insurance agent David Kolpakchi after he completed his court-ordered probation, a spokesman for the District Attorney's elder abuse unit told Compliance Complete on Monday. A dismissal is discretionary under state law in certain cases where a defendant is convicted of a misdemeanor, and was entered on December 19, 2012 by Judge Beverly Reid O'Connell. Kolpakchi was initially charged with a felony but pled guilty to a reduced charge, the unit's spokesman confirmed. Compliance Complete reported Kolpakchi's sentencing on March 6, 2009, noting that he was ordered to serve five years formal probation. The court terminated Kolpakchi's probation in November 2012, little more than halfway through the initial term, the elder-abuse unit spokesman said. Kolpakchi was also ordered to pay $15,059 in restitution to insurance companies that were the targets of his scams, and to pay $23,300 to the state Department
